Terms and Conditions

1. WHO WE ARE

These general terms and conditions (the “Terms”) govern the services provided by NEW WAVE SERVEIS TURISTICS, SL (“New Wave”), Tax ID number B17915778, with registered address at Carrer dels Rossinyols 33, 17310 Lloret de Mar, Girona, Spain, and email info@newwavest.com. They complement, and are read together with, the Legal Notice, the Privacy Policy and the Cookie Policy published on www.newwavest.com.

2. SCOPE AND ACCEPTANCE

The Terms apply to enquiries, quotations, bookings and services arranged by New Wave: group and individual travel, school trips, special events, transfers and transport, and the accommodation, activities and services contracted alongside them. Requesting a quotation or confirming a booking implies acceptance of these Terms in the version in force on that date. Where a signed contract, a written quotation or a service order sets out different conditions for a specific booking, those conditions prevail over these Terms.

3. QUOTATIONS AND BOOKINGS

Quotations are prepared on the basis of the information supplied by the client — dates, number of travellers, ages, services requested — and are valid for the period stated in each quotation. Availability is confirmed only when New Wave issues a written booking confirmation. Until then, prices and availability are subject to change. The client is responsible for checking that the names, dates and details on the confirmation are correct, and for reporting any discrepancy without delay.

4. PRICES, TAXES AND PAYMENT

Prices are those stated in the accepted quotation or booking confirmation, in euros, and include the taxes indicated there. Unless the confirmation says otherwise, they do not include flights, personal expenses, optional activities, local tourist taxes payable at the destination, or anything not expressly listed as included. Deposits, payment dates and the final balance are set out in each confirmation; failure to pay by the agreed dates may release New Wave from its obligation to provide the services, without prejudice to any cancellation charges already incurred.

5. CHANGES REQUESTED BY THE CLIENT

Changes to a confirmed booking — dates, numbers, rooming, itinerary — must be requested in writing and are subject to availability and to the conditions of the suppliers involved. Any resulting difference in price, together with any fee charged by a supplier, is payable by the client.

6. CANCELLATION

Cancellations must be notified in writing and take effect on the date New Wave receives them. The charges that apply are those stated in the booking confirmation, which reflect the conditions of the hotels, carriers and other suppliers contracted for that booking. Where a booking falls within the scope of the rules on package travel and linked travel arrangements (Royal Legislative Decree 1/2007, as amended), the rights those rules give the traveller — including the right to withdraw before the start of the package against payment of an appropriate termination fee, and the right to terminate without a fee in the event of unavoidable and extraordinary circumstances at the destination — apply in full and are not limited by these Terms.

7. CHANGES OR CANCELLATION BY NEW WAVE

If, before departure, New Wave has to change a significant part of a confirmed service, the client will be told as soon as possible and may accept the change, accept a replacement service of an equivalent standard, or cancel and be refunded the amounts paid for the part not provided. Minor adjustments — a change of hotel to another of the same category, a reordering of the programme, a change of vehicle or driver — do not give rise to compensation. New Wave may cancel a booking that depends on a minimum number of participants if that number is not reached, giving notice within the period stated in the confirmation and refunding what has been paid.

8. THE CLIENT’S OBLIGATIONS

Travellers are responsible for carrying valid identity documents, passports, visas and any health documentation the trip requires, and for meeting the entry requirements of the countries visited. New Wave is not liable for the consequences of missing or invalid documentation. Travellers must be at the agreed pick-up points at the agreed times, follow the reasonable instructions of guides, drivers and suppliers, and respect the rules of the accommodation and venues used. Suppliers may refuse or end a service where conduct endangers other travellers, staff or the vehicle, without any right to a refund.

9. GROUPS, SCHOOL TRIPS AND MINORS

For school and youth groups, the organising centre appoints the group leaders, who remain responsible for supervising the participants throughout the trip and who provide New Wave with the emergency contact details of a person responsible for each minor. The ratio of leaders to participants is the one agreed in the booking confirmation. Damage caused to accommodation, vehicles or venues is payable by the group in accordance with the supplier’s claim.

10. TRANSPORT

Transport is provided by licensed carriers holding the authorisations and insurance required by law, and is subject to the rules on driving and rest periods for professional drivers, which cannot be waived at the client’s request. Timings may be affected by traffic, weather, road closures or other circumstances beyond our control; where that happens, New Wave will look for the best available alternative.

11. INSURANCE

New Wave holds the liability insurance required of it by law. Travel, cancellation, medical and baggage insurance is not included unless the booking confirmation expressly says so. We recommend that every traveller holds cover appropriate to the trip, and we can arrange it on request.

12. LIABILITY

New Wave answers for the correct provision of the services it has undertaken to arrange, in accordance with the applicable consumer and travel legislation. It is not liable for events attributable to the traveller, for the unforeseeable or unavoidable acts of a third party unconnected with the services, or for unavoidable and extraordinary circumstances. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or any other liability that cannot be limited under Spanish law.

13. COMPLAINTS AND DISPUTE RESOLUTION

Any incident during the trip should be reported at the time to the guide, the driver or the New Wave office so that it can be resolved on the spot. Complaints may be sent afterwards to info@newwavest.com, and official complaint forms (hojas de reclamación) are available at our office. Consumers may also use the European Commission’s online dispute resolution platform at https://ec.europa.eu/consumers/odr.

14. DATA PROTECTION

Personal data provided in the course of an enquiry or a booking is processed as described in our Privacy Policy, which explains the purpose, the legal basis, the recipients and how to exercise your rights.

15. APPLICABLE LAW AND JURISDICTION

These Terms are governed by Spanish law. Any dispute will be heard by the courts determined by the applicable procedural rules; where the client is a consumer, that means the courts of the consumer’s place of residence.

16. CHANGES TO THESE TERMS

New Wave may update these Terms to reflect changes in its services or in the law. The version published on this page when a booking is confirmed is the one that applies to that booking.
